§1. Terms of Use

  1. Maltazar is free and requires no registration or app installation.
  2. Participation is voluntary and available to anyone who accepts these terms.
  3. Players provide a nickname (alias), it does not have to be a real name.
  4. GPS check-in requires physical presence within 100 meters of the location.
  5. Points and trophies are for entertainment only and cannot be exchanged for monetary rewards.
  6. The operator reserves the right to change progress points, locations, and product rules without notice.

§2. Photos, Rights & License

  1. Adding a photo during check-in is entirely optional. You may skip this step.
  2. By uploading a photo, you grant the operator a free, non-exclusive, perpetual, worldwide license to use the photo, including but not limited to:
    • publication on social media (Facebook, Instagram, TikTok, Pinterest, YouTube, and others),
    • advertising and promotional materials for the service and its channels,
    • production of calendars, postcards, and other printed materials,
    • online publication on the operator's websites.
  3. Photos may be cropped, color-graded, and stylized by the operator (including using AI tools).
  4. The player declares they are authorized to grant the above license, and that the photo does not infringe third-party rights.
  5. Uploading photos containing illegal, offensive, or privacy-violating content is prohibited.

§3. Personal Data Protection (GDPR)

  1. The data controller is HESTER'S HELPING HANDS, LLC (contact: [email protected]).
  2. Data collected: player nickname, points, trophies, location photos, timestamps.
  3. Photos and videos are stored while the account and community features are active, and then as needed for moderation, security, claims and the granted licence. You may request deletion of your data.
  4. Profile and discovery data (nickname, points) may be stored as needed for saved places and community features.
  5. Players have the right to access, correct, and delete their data. Contact: [email protected].
  6. Data is not sold to brokers. It is shared only with necessary hosting, database, security and content-publication providers.

§4. No Payments in the Product

  1. Maltazar is free. The product does not take payments and does not currently sell products through the website.
  2. Any future paid feature or product will have separate terms, pricing and explicit agreement before purchase.
  3. Ads or links to external services are separate offers and are not a condition of using the product.

§5. Final Provisions

  1. The operator reserves the right to block a player's account for violating these terms.
  2. Matters not covered by these terms are governed by Florida law, without limiting mandatory consumer and data-protection rights.
  3. Disputes may be heard by a court with jurisdiction over the operator's principal office unless mandatory law gives the user a right to another court or process.
  4. These terms may be amended. The current version is always available at this address.
